Thomas F. Maffei, of counsel in the firm’s Litigation Department, was quoted in a Massachusetts Lawyers Weekly article entitled, “Restrictions on Property Transfer Deemed Invalid,” on July 2, 2018.

From the article:

Another problem in the present case was that the price term in the transfer restriction agreement was “not really a price term,” said Boston attorney Thomas F. Maffei, who successfully represented the defendant before the SJC in Bortolotti.

By forcing the would-be seller to go before a panel of arbitrators who could revise downward an offer the seller had received, the provision would “eliminate the free back-and-forth that typically goes on with the buying and selling of real estate,” Maffei said.
