Brian J. MacDonough quoted in Massachusetts Lawyers Weekly on Wage Act Appeals Court decision
Brian J. MacDonough, co-chair of the firm’s Employment Department, was quoted in the November 1st issue of Massachusetts Lawyers Weekly. The article, “Eye doctor cannot sue under Wage Act after practice breakup,” discusses the Massachusetts Appeals Court’s decision in O’Connor, et al. v. Kadrmas. The Court ruled an ophthalmologist could not proceed with a claim for treble damages under the Wage Act for amounts allegedly due pursuant to the terms of his shareholder agreement with his partners.

“The important thing to remember about the Wage Act is that it’s a strict liability statute,” MacDonough said. “There are significant mandatory damages in the form of treble damages and attorneys’ fees. You see the most recent appellate decisions striking a balance where not every form of compensation is going to be addressed under the Wage Act and subjected to these significant penalties.”
