Daniel S. Guenther quoted in Massachusetts Lawyers Weekly article about Chapter 93A and ‘junk fees’

Daniel S. Guenther, partner in the firm’s Litigation Department was quoted in a Massachusetts Lawyers Weekly article on April 3, titled “AG throws down Chapter 93A hammer on ‘junk fees.’” The article discusses Massachusetts Attorney General Andrea Campbell’s recent move to adopt consumer protection regulations that will require sellers to disclose the total cost of a product or service from a customer’s initial interaction with it, instead of surprising consumers with the fees only once they are ready to check out.

From the article:

“When this gets litigated, a lot of these cases are going to come down to the definition of ‘total price,’” Guenther said. “[The regulation defines] total price as ‘the maximum price a consumer must pay for any mandatory ancillary Product.’ If you think about how many [products] have various fees, a lot of these cases are going to come down to what were the ‘mandatory’ additional products or parts of this thing you were buying.”
