David I. Brody quoted in Massachusetts Lawyers Weekly
David I. Brody, associate in the firm’s employment law and litigation departments, was quoted in a Massachusetts Lawyers Weekly article, entitled “MassHealth intermediary not home health aide’s employer,” on September 25, 2017, in regards to the cases Gallagher v. Cerebral Palsy of Massachusetts, Inc. and Sebago v. Boston Cap Dispatch, Inc.

While agreeing that the decision was motivated by a desire to save the regulatory framework, Boston attorney David I. Brody said he doubts the court’s reliance on Sebago will stand up over time, given that the SJC engaged in a “very fact-intensive analysis” in Sebago.
Moreover, he said the provision-of-services test that the Appeals Court laid out in Gallagher was not faithful to the text of §148B, which he noted “does not cap the number of employers an individual can have.”
