David I. Brody, partner in the firm’s Employment Department was quoted in the Massachusetts Lawyers Weekly article, “Attorneys assess EEOC as consequential election nears” on October 25th, 2024. The article analyzes the results of an annual survey of Equal Employment Opportunity Commission (EEOC) activity through opinions offered by different Massachusetts attorneys.

As reported by Lawyers Weekly in April, the Massachusetts Commission Against Discrimination has gotten so bogged down by its backlog of cases that Lawyers for Civil Rights and the Urban League of Eastern Massachusetts threatened a federal lawsuit.

And yet, plaintiffs-side employment lawyer David I. Brody said his first thought upon seeing the EEOC data was that the MCAD, for all its warts, “does provide real benefits for individuals.”

In the most recent year for which data was available, the MCAD had issued between 200 and 250 probable cause determinations.

“Those are people who, as a matter of right, get commission counsel and can litigate their claims in the name of the commonwealth,” Brody said. “So, if I’m an individual without an attorney, I like my odds a heck of a lot better in the state system than I do in the federal.”
