The article, “Legal-mal survey reveals ‘unrelenting’ threat environment,” details best practices to minimize legal malpractice risks from experts following a recently released national survey of leading professional liability insurers that shows an unsettling number of large legal malpractice settlements.

Boston professional liability attorney Edward S. Cheng said cybercrime involving money transfers in real estate transactions has become another source of litigation.

“Cybercriminals are becoming more and more imaginative in terms of getting into these transactions, whether it’s spoofing emails or intercepting cellphone communications,” Cheng said. “That’s an increasing area of exposure for attorneys.”

“Let’s say you have a partnership for a development and you sell the property,” Cheng said. “You see a fair number of cases coming out of disputes over the splitting of the proceeds. With that much money at stake, pointing the finger at someone’s attorney is not unheard of.”
