Sander A. Rikleen, a real estate litigator in Boston, said he was not surprised to see HAC come down on the side of the developer in Meredith.
“Their whole purpose is to overcome local opposition to affordable housing projects,” Rikleen said. “So I would expect the lens with which they review things would be quite sensitive. And one of the things you must be concerned about in these cases is that delay is a factor in opposition strategy. Some number of projects simply go away with delay. Building costs change. Financing costs change. So, I would think HAC would be sensitive to concerns about delay.”
