Scott McConchie is an experienced civil litigator, with a focus on commercial and employment litigation.
A partner in the firm’s Litigation Department, Scott regularly appears in state and federal court, representing large corporations and financial institutions, small businesses, and individuals. A member of the bar since 1996, Scott has deep experience litigating business/contract disputes, malpractice claims, trade secret actions, and restrictive covenant disputes. He also has experience in bar disciplinary proceedings. Scott’s approach to litigation is collaborative; he works with – and not simply for – his clients in developing creative and pragmatic solutions to the problems his clients face.
In 2024, Scott was appointed to the Client’s Security Board (CSB) of Massachusetts by the Justices of the Supreme Judicial Court (SJC). Scott’s 5-year term began on December 2, 2024. The SJC appoints seven Massachusetts lawyers to act as public trustees for the CSB, which reviews claims, makes awards, and distributes funds (which come from Massachusetts lawyers through their annual registration fees).
Scott previously served two terms as a Hearing Committee Member for the Board of Bar Overseers (BBO). The Hearing Committees are fact-finding tribunals in disciplinary proceedings; as such, they hear testimony, take evidence, make adjudicatory rulings, and prepare a written report and recommendation for the BBO. Scott also has served on the Boston Bar Association (BBA) Business and Commercial Litigation Steering Committee, and is a past board member of the Political Asylum/Immigration Representation (PAIR) Project and of the Lawyers Clearinghouse on Affordable Housing and Homelessness.
Experience
- Represented non-profit organization in construction defect litigation. Case resulted in favorable settlement at mediation.
- Represented former senior executives of Fortune 100 company in arbitration brought by company arising out of restrictive covenants.
- Represented two doctors/stockholders against private equity firm that had purchased their practice and then sold it several years later at significant loss. Litigation avoided.
- Sued architect for design defects in new medical building owned by local hospital, resulting in a settlement at a pre-discovery mediation.
- Represented a number of out-of-state moving companies in action against website that manipulated third-party reviews. Case resulted in favorable settlement at mediation.
- Filed suit against consultant which botched software standardization project for specialty paper manufacturer. Case resulted in favorable settlement.
